Zhang has suffered from torture repeatedly since her detention. During Christmas (25-27 December 2020), she was forced to wear shackles and handcuffs again. She reported to the authorities of the physical pain she could hardly bear and asked for a nuclear magnetic resonance spectroscopy to get a clearer diagnosis. Instead of providing her medical treatment, the authorities only gave her some painkillers. Zhang’s family hopes that the public would continue to follow the case and speak out for her.

張五洲為湖北人,自 2015 年因其弟張六毛被控「尋釁滋事罪」後離奇死於廣州第三看守所而追尋真相,其後更因參與多宗維權事件而被捕。 2018年9月20日,廣州女律師孫世華在廣州荔灣區華林派出所辦案時,受到該所民警毆打並遭脫衣檢查侮辱。隨行的張五洲和梁頌基作為目擊者,在網上公開為孫世華作證。廣州警方為此報復,以「尋釁滋事罪」抓捕了張五洲和梁頌基。梁頌基因此被判刑1年半、張五洲被判刑1年4個月。張於2020年2月14日刑滿出獄。

2020年6月4日,張五洲手持「勿忘六世,撤回惡法」及「女律師被毆打,目擊證人行乞」的標語在廣州市白雲山雲天南路街頭悼念六四,並表示反對中共推行「港區國安法」,其後更拍攝照片發佈至微信朋友圈及微信群。

清遠市公安於翌日下午以涉嫌擾亂公共秩序為由將張五洲從家中帶走,24 小時後轉為以「尋釁滋事罪」將他刑事拘留,羈押於清遠市清新區看守所。6月20日正式被批捕,2020年8月19日被以「尋釁滋事罪」和「妨害公務罪」起訴。

張的妹妹表示有一位姓朱的律師主動要提供法律援助,並聲稱張五洲在看守所內情緒穩定,狀態良好,但家人並不信任她。因此,家人為她聘請了黃思敏律師。

7月22日,張五洲終於能和家人聘用的律師見面。張向黃思敏律師表示在看守所內受到酷刑,從6月7日到6月12日一直戴著一百多斤的腳鐐,而銬住手的手銬則銬在腳鐐上,整個人只能縮成一團,這樣持續了6天6夜,感覺是生不如死。在裡面還被同倉囚犯毆打。

2020年11月24日開審,僅張的兒子可以在場旁聽,其他到場支援的朋友被國安帶走。張五洲堅定認為自己不構成任何犯罪,辯護律師在庭上提出,當事人的行為是屬於言論自由範疇,但審判長一聽,就要她不要「談這些無關的」。當日未有判決。

Description:
Originally from Hubei Province, Zhang Wuzhou became a human rights activist after her younger brother Zhang Liumao’s mysterious death in Guangdong Province. Zhang Liumao died in Guangzhou No. 3 Detention Centre after being detained for “picking quarrels and provoking trouble". Since then, Zhang Wuzhou kept demanding an answer from the authorities and started to get involved in other human rights activities.

On 20 September 2018, when Lawyer Sun Shihua was handling a case at Hualin Police Station in Liwan District, Guangzhou, police assaulted her and insulted her by forcing her to go through a strip search. Zhang Wuzhou and Liang Songji were accompanying Lawyer Sun and witnessed the whole incident. They later made a public testimony online to support Sun Shihua’s accusation against the police. As retaliation, the Guangzhou police arrested Zhang and Liang for “picking quarrels and provoking trouble". Liang was sentenced to one year and six months and Zhang Wuzhou was sentenced to one year and four months. Zhang was released from prison on 14 February 2020, after serving her sentence.

On 4 June 2020, Zhang posed for photos at Guangdong’s Baiyunshan scenic area on the 31st anniversary of the Tiananmen massacre, holding up slogans that read “Don’t forget June 4th, withdraw the draconian law" as to oppose Beijing’s plan to impose draconian sedition legislation on Hong Kong and “lawyer was assaulted and her witness became a beggar” regarding her own case. She then uploaded the photos to her WeChat account and some other WeChat groups.

The Qingyuan City Police took Zhang Wuzhou away from her home on the grounds of disturbing public order in the afternoon of 5 June 2020. The next day she was transferred to criminal detention for “picking quarrels and provoking trouble" and detained in the Qingxin District Detention Centre. On 20 June, she was formally arrested and on 19 August 2020, she was indicted for “picking quarrels and provoking trouble" and “obstructing official duties".

Zhang’s younger sister said she was contacted by a certain lawyer named Zhu, offering to provide free legal aid to Zhang, claimed that she visited Zhang in the detention center and Zhang was calm and in good conditions. Zhang’s sister did not trust this lawyer and employed Lawyer Huang Simin instead.

On 22 July, Zhang Wuzhou was finally allowed to meet with the lawyer hired by her family. She told Lawyer Huang that she was tortured in the detention centre. From 7 June to 12 June, she was forced to wear shackles weighted over 100 catties and they were interlocked with her handcuffs. Therefore, she had to bend and twist her body like a ball for six days and she was in deep pain. Moreover, she was beaten by other prisoners in her cell.

The first hearing took place on 24 November 2020. Only Zhang’s son was allowed to attend, while her friends who came to support her were taken away by the state security police officers. Zhang maintained that she did not break any laws and her lawyer defended her in cour that Zhang’s behaviour was only to exercise her freedom of speech. However, the judge told the lawyer not to mention the “unrelated matters". No verdict has been delivered after this hearing.

2020年2月15日,許志永被拘捕(許志永一案的連結),李翹楚在北京亦被公安帶走,被「指定監所監視居住」及禁止通訊拘留,無法聯絡家人也不得選擇委任律師,外界因此極為擔憂她可受遭到酷刑或其他不人道對待,至6月19日才獲取保候審。她把被秘密關押的經歷寫成《李翹楚:被連坐煽顛、指定監視居住的120天》系列文章,詳細講述了自己被關押期間所遭受的酷刑及不人道虐待,因此多次被威脅,警方甚至聲稱「隨時可以再把你抓進去判刑」,並被要求刪除推特上的相關內容。同時,李翹楚的父親也遭到警方的多次傳喚威脅。

李翹楚取保候審期間,仍堅持為許志永、丁家喜常瑋平等1226公民案中被關押的人士發聲,並維護自己的公民權利,她曾就北京市公安局在2020年11月26日以來的諸多違法行為公開提起控告,要求北京市檢察院依法監督並糾正北京市公安局的違法行為,並歸還其相關的法律文書及被非法扣押的個人物品。

2021年1月21日許志永的辯護律師梁小軍和張磊在山東省臨沭縣以視頻會見了與外界失聯達一年的許志永。李翹楚得知並公開了許志永在被指定居所監視居住期間,曾經遭到了10天被剝奪睡眠的虐待(其中前5天每天睡眠4個小時,後5天每天睡眠2個小時);在被匿名羈押在臨沭縣看守所,每天的伙食每頓只有1個饅頭等,因牢房冰冷而凍傷的境況後,於1月31日就伙食問題向臨沂市公安局寄出了政府信息公開申請,2月2日就伙食遠低於國家標準和高價買餐的問題對臨沭縣看守所進行了控告;同時李翹楚就案件偵查階段以飢餓作為酷刑控告臨沂市公安局。

2月6日,李翹楚被山東警方以涉嫌「顛覆國家政權罪」押往臨沂,3月15日正式被捕。 據了解,李現被監禁在臨沂市人民醫院東區的監所醫院,其親友因此擔憂李翹楚的抑鬱症及身體健康狀況。

Description:
Li Qiaochu graduated from the School of Labour and Human Resources of Renmin University of China, and later received a master’s degree in public policy from the University of York in the UK. She then worked as a research assistant at Tsinghua University, has long lobbied for and researched in labor, women’s rights and civil rights issues in Mainland China, including the rights to employment and housing of the migrant workers during the mass eviction of the so-called “low-end population” in Beijing in 2017. She has been a vocal figure in China’s #MeToo movement. At the same time, she is also the girlfriend of legal scholar Xu Zhiyong, the founder of the New Citizens’ Movement.

Her long-term involvement and commitment in civil society activities makes her the target of harassment by state security officers and police on many occasions. She was diagnosed with depression in June 2019 and since then, she must take medication regularly as prescribed. Yet she continued to fight for women’s rights and labour rights. Starting from December 2019, state security officers guarded outside her residence and followed her to work everyday, seriously infringing her privacy and civil rights.

On 15 February 2020, Xu Zhiyong was detained (Details of Xu Zhiyong’s case) in Guangdong Province. Li Qiaochu was also taken away by the police in Beijing and held under “residential surveillance in a designated location” for over four months. She was unable to contact her family or appoint a lawyer. Her family and friends feared that she might be subjected to torture or other inhumane treatment. On 19 June 2020, she was granted bail pending trial. She released a series of articles entitled “Li Qiaochu: 120 days of being detained for inciting subversion of state power and residential surveillance in a designated location”, detailing the torture and inhumane ill-treatment she had suffered. During those four months, she was repeatedly threatened by the police that she would be arbitrarily detainedagain and even sentenced to jail. The police also warned her to delete the contents of her Twitter account. Her father was threatened to report to the police station constantly.

During Li Qiaochu’s release on bail, she continued to voice out for Xu Zhiyong, Ding Jiaxi, and Chang Weiping and those detained due to the “1226 Crackdown”, and defending her own civil rights. She filed complaints at the Beijing Municipal Procuratorate, calling it to supervise and correct the violations by the Beijing Municipal Public Security Bureau, return certain legal documents and those illegally seized personal items to her. On 21 January 2021, Xu Zhiyong’s defense lawyers Liang Xiaojun and Zhang Lei finally met with Xu in Linshu County, Shandong Province, who had been out of contact with the outside world for a year. Li Qiaochu learned the details from this meeting and disclosed that Xu Zhiyong had suffered 10 days of sleep deprivation during residential surveillance in a designated location (including 4 hours of sleep a day for the first 5 days and 2 hours a day for the next 5 days); he was kept in custody anonymously, the Linshu County Detention Centre gave him only one steamed bun per meal each day; Xu got frostbite due to lack of heating in his cell and, etc. On 31 January 2021, she applied for information disclosure at the Linyi City Public Security Bureau. On 2 February, she sued the Linshu County Detention Centre for providing overpriced meals far below the national standards of meals for detainees; at the same time, she sued the Linyi City Public Security Bureau for using starvation as a form of torture in the investigation stage.

On 6 February, Li Qiaochu was taken to Linyi City on suspicion of “subverting state power" and formally arrested on 15 March 2021. It is reported that Li is detained in the prison hospital in the eastern wing of Linyi City People’s Hospital. Her family and friends are worried about Li Qiaochu’s depression and health.

張賈龍 – 傳媒人聲援香港「反送中」運動,被控「尋釁滋事罪」判有期徒刑一年半,2月11日刑滿出獄

張賈龍原《騰訊財經頻道》編輯,及《財經》雜誌編輯,曾報導艾未未北京工作室被強拆和「結石寶寶之父」趙連海維權訊息。後因報導北京出租車司機罷工被行政拘留。2014年美國前國務卿克里訪華時曾與他見面,批評中國的互聯網審查和人權問題。另外,他曾繫黃絲帶聲援香港「雨傘運動」。2019年香港「反送中」運動期間被中國當局針對。2019年8月在貴陽家中被公安帶走,其後被控「尋釁滋事罪」,2021年1月8日被判到一年半。扣除 #張賈龍 被拘留的日子,他於2021年2月11日刑滿出獄,回家過春節。張賈龍的妻子邵媛告訴記者,張賈龍狀況尚可,但稍微消瘦。由於目前仍處於取保階段,因此不便多說,但感謝外界關心。

Zhang Jialong was a former editor of Tencent’s Finance Channel and a former of editor of Caijing magazine. He had covered the demolition of artist Ai Weiwei’s Beijing studio and Zhao Lianhai, who represented victims of toxic milk powder. He was administratively detained after reporting Beijing taxi drivers’ strike. In 2014, he met with former US Secretary of State John Kerry and criticised China’s censorship and human rights records. He also showed his support for Hong Kong’s “Umbrella Movement”. During the Anti-Extradition Bill protests in HK, he was targeted by mainland authorities. He was taken away from his home in Guiyang in August 2019. He was later accused of “picking quarrels and provoking trouble” and only sentenced on 8 Jan 2021. Deducting the period of #ZhangJialong’s detention, he was released on Lunar New Year’s Eve (11 Feb 2021) and could go home for the Spring Festival. Zhang Jialong’s wife, Shao Yuan, told media that Zhang Jialong’s condition was fine, although he lost some weight. Since Zhang is currently released on bail, it is better for them to keep quiet for the time being, but the family is grateful to the support from outside.

張在2014年2月美國前國務卿克里(John Kerry)訪華期間應邀會面,批評中國的監控體系及網絡審查制度,呼籲美國關注中國的互聯網自由、人權活躍人士如許志永和劉曉波,並建議克里探望劉霞。張賈龍在《外交政策》上發表文章〈我想告訴克里的所有事〉,解說這次會議的想法,他希望美國拒絕發簽證予中國負責防火長城相關人員,包括北京郵電大學校長兼防火長城創造人之一方濱興。張賈龍因此被騰訊找藉口「洩露商業秘密等敏感信息行為」解聘後,再沒有穩定工作。

張賈龍近年回到家鄉貴陽生活,成為活躍的網絡作者,但一直比較低調,被抓前女兒剛出生,估計是次被捕是政治報復,或與他曾聲援2014年香港「雨傘運動」有關。當時他曾上傳佩戴黃絲帶照片聲援香港,其後亦多次轉發有關港台的消息,疑因此於2019年「反修例運動」期間被當局針對。他的被捕和開庭備受國際關注,美國國務院發言人和無國界記者均曾呼籲中國釋放張賈龍。

2019年8月12日,張在貴陽家中被公安和維穩人員帶走,翌日被刑事拘留,涉嫌「尋釁滋事罪」,至2019年9月13日正式批捕。去年檢察當局曾遊說張妻邵媛勸張妥協,以撰寫認罪材料換取輕判,當時遭邵媛拒絕。2019年12月初,張被正式起訴。

2020年5月13日,案件在貴陽市南明區法院開庭,起訴書稱張賈龍自2016年以來,在推特發布大量詆毀黨、國家和政府形象的虛假信息,應當以「尋釁滋事」追究刑事責任。

當局以2019冠狀病毒疾病(COVID-19)疫情為由拒發旁聽證,並中途攔阻多名欲前往法院表達關心和支持的張賈龍友人。張在庭上表示他所發的推特言論屬個人言論自由,沒有構成犯罪。
2021年1月8日,法院在庭審後八個月作出判決,判處張賈龍有期徒刑一年半,張不服判決表示會上訴。扣除張被拘留的日子,他於2021年2月11日刑滿出獄,回家過春節。張賈龍妻子邵媛告訴記者,張賈龍狀況尚可,但稍微消瘦。由於目前仍處於取保階段,因此不便多說,但感謝外界關心。

Description:
Zhang Jialong was previously employed as an editor of Tencent Website’s Finance Channel. He once reported that the artist Ai Weiwei’s studio was demolished, documented Zhao Lianhai’s campaign, who fought for the children who had been harmed during the 2008 Chinese toxic milk powder scandal. In April 2011, Zhang’s home was searched and he was administratively detained for ten days after posting on Twitter that Beijing taxi drivers were about to go on strike. The Beijing police described him as “advocating strikes on the Internet" and “a dangerous person who attempted to cause trouble and disrupt public order in the capital”.

In February 2014, Zhang was invited to meet with former U.S. Secretary of State John Kerry when he visited Beijing. Zhang criticized China’s surveillance system and internet censorship, called on the United States to pay attention to China’s internet freedom and human rights activists such as Xu Zhiyong and Liu Xiaobo, and suggested Kerry to visit Liu Xia (Liu Xiaobo’s wife). Upon invitation by the Foreign Policy website, Zhang wrote an article spelling out everything he would like to say to Kerry in that meeting, including hoping that the United States would implement visa sanctions on those who contributed to create the Great Firewall (GFW), such as Fang Binxing, the father of GFW and then President of Beijing University of Posts and Telecommunications. In May 2014, Tencent terminated his employment contract, accusing him of “leaking business secrets and other confidential and sensitive information". Since then, Zhang could not find any stable jobs.

Some years ago, Zhang moved back to his hometown Guiyang City in Guizhou Province. He became an active blogger but kept a low profile. His daughter was just born when he was detained in August 2019. It is believed that the arrest was political retaliation or related to his support to the Umbrella Movement in Hong Kong in 2014. At that time, he uploaded a photo wearing a yellow ribbon in support of Hong Kong people, and also shared news about Hong Kong and Taiwan repeatedly. His arrest in 2019 could be seen as a warning to other activists, as the Anti-Extradition Law Amendment Bill protests waged on in Hong Kong. His arrest and court hearing have attracted international attention. Both the spokesperson of the US State Department and Reporters Without Borders called on China to release Zhang Jialong.

On 12 August 2019, Zhang was taken away from his home in Guiyang City by police and state security personnel. He was criminally detained the next day on suspicion of “picking quarrels and provoking trouble" and formally arrested on 13 September 2019. The procuratorial authorities lobbied Mrs. Zhang, Shao Yuan to persuade Zhang to compromise and write a confession statement in exchange for a more lenient sentence, but Shao Yuan refused. In early December 2019, Zhang was formally indicted.

The first hearing was held in the Nanming District People’s Court of Guiyang City on 13 May 2020. The indictment stated that Zhang Jialong had posted a large number of false information on Twitter since 2016 that slandered the image of the party, the country and the government, and therefore should be held criminally responsible for “picking quarrels and provoking trouble”.

Citing COVID-19 pandemic, the authorities disallowed observers to the hearing and stopped several of Zhang Jialong’s friends who wanted to go to the court to show their concern and support. Zhang defended himself in court, stating that he was exercising his freedom of speech in tweeting and it did not constitute a crime.

On 8 January 2021, the court finally rendered a verdict eight months after the trial and sentenced Zhang Jialong to18 months in prison. Zhang disagreed with the verdict and planned to appeal. Deducting the period of Zhang’s detention, he was released on Lunar New Year’s Eve (11 February 2021) and could go home for the Spring Festival. Zhang Jialong’s wife, Shao Yuan, told media that Zhang Jialong’s condition was fine, although he lost some weight. Since Zhang is currently released on bail, it is better for them to keep quiet for the time being, but the family is grateful to the support from outside.

劉艷麗:「言論自由是公民權利。」被指網上散佈虛假信息,以「尋釁滋事罪」判有期徒刑4年

在庭審近15個月後,2020年4月24日,法院以「尋釁滋事罪」判處 #劉艷麗 4年有期徒刑,判決書顯示案件涉及網上言論與攻擊、侮辱黨和國家領導人以及有損政府形像有關,刑期至2022年3月23日,劉不服上訴,二審維持原判。在2019年1月31日的庭審中,控方以29條消息和文章為依據,指控劉艷麗在網上散佈虛假信息,攻擊黨和國家領導人,惡意炒作社會熱點事件,但沒有提供所謂損害社會秩序的後果證據。劉艷麗為自己作無罪自辯,指言論自由是公民權利。

Nearly 15 months after the trial, on 24 April 2020, the court sentenced #LiuYanli to 4 years in prison for “picking quarrels and provoking trouble", till 23 March 2022. The verdict indicates that Liu’s case involved online speech and attacks, insults to party and state leaders, and damage to the image of the government. Liu appealed but the same verdict was upheld in the second hearing. The prosecution accused Liu Yanli of spreading false digital information, namely 29 messages and articles, to attack party and state leaders, and maliciously stir up popular social events. However, the authorities did not provide evidence of the so-called damage she had caused. Liu Yanli pleaded not guilty, stating that freedom of speech is a citizen’s right.

本為銀行職員的劉艷麗,同時也是活躍的博客作者。自2009年至今,劉艷麗因在QQ空間及微信論及民主政治,尤其是自2012年起積極組織關愛抗戰老兵活動,要求官員資產透明化而受到當局打壓。

2016年,劉艷麗曾因在微信朋友圈轉發和發送涉及毛澤東、周恩來、習近平等中共領導人信息,在2016年5月30日被湖北省荊門市警方以涉嫌「誹謗罪」刑事拘留8個月。其後她獲取保候審,2018年5月27日起又被監視居住,2018年11月22日,她的罪名被改為涉嫌「尋釁滋事罪」被逮捕。當局指控其妄議中共國家領導人(指毛澤東、周恩來、習近平等),屬於「辱罵、攻擊中國共產黨」,其言行涉嫌誹謗他人和擾亂了社會秩序。

2018年在關押期間劉曾割腕自殺獲救,但雙腕受傷,左腕尤其嚴重,幾根神經斷裂。國保從未通知家屬,治療未結束就匆匆將她關進看守所。

Liu Yanli, a bank clerk, was also an active blogger. Since 2009, Liu Yanli has started discussing democratic movement in QQ Zone and WeChat, and from 2012 on, she has organized activities to support veterans of World War II and demanded officials to disclose their assets. She suffered harassment and was arrested on numerous occasions for her social media posts.

On 30 May 2016, Liu Yanli was detained by the police of Jingmen City, Hubei Province for eight months on suspicion of “defamation" for sharing messages mentioning Mao Zedong, Zhou Enlai, Xi Jinping and other CCP leaders at WeChat. She was subsequently granted bail pending trial and was placed under “residential surveillance in a designated location” on 27 May 2018. On 22 November 2018, she was formally arrested on suspicion of “picking quarrels and provoking trouble."

The authorities accused her that her messages which mentioned the leaders of the Chinese Communist Party (referring to Mao Zedong, Zhou Enlai, and Xi Jinping) as “insulting and attacking the Chinese Communist Party," and her words and deeds were suspected of slandering others and disrupting social order. While in custody in 2018, Liu Zeng attempted suicide by cutting her wrists and was rescued. However, both wrists were injured, particularly her left wrist with several nerves disconnected. The officers of the detention centre never notified the family about her injury, hurriedly sent her back to the detention centre before the treatment was complete.

In the court trial on 31 January 2019, the prosecutor accused Liu Yanli of spreading false digital information, namely 29 messages and articles, to attack party and state leaders, and maliciously stir up popular social events. However, the authorities did not provide evidence of the so-called damage she had caused. Liu Yanli pledged innocence, stating that freedom of speech is a citizen’s right, criticizing current affairs and caring about public events is a citizen’s conscience and social responsibility.

It took over one year till the court delivered its verdict. On 6 and 7 November 2019, Liu launched a hunger strike to protest against the long detention without any judgment.

On 24 April 2020, the court sentenced Liu Yanli to four years in prison for “picking quarrels and provoking trouble", till 23 March 2022. The verdict indicates that Liu’s case involved online speech and attacks, insults to party and state leaders, and damage to the image of the government. Liu appealed but the same verdict was upheld in the second hearing.

Since the COVID-19 Lockdown in Hubei Province in January 2020, the authorities have cited the pandemic as an excuse to stop Liu’s family members and lawyers to visit her. The family is very worried about her situation, fearing for her mental health. Reporters Without Borders and Independent Chinese PEN requested the Chinese government to release Liu Yanli immediately. Independent Chinese PEN awarded Liu Yanli the 2018 Lin Zhao Memorial Award.

李新德 – 創立中國輿論監督網,以「非法經營罪」被判有期徒刑5年

2021年1月7日,江蘇省邳州市法院以「非法經營罪」判處長年以輿論監督官員腐敗的#李新德 有期徒刑5年,刑期至2024年10月9日,處罰人民幣30萬元。其子李超被判處有期徒刑1年,處罰人民幣5萬元。2019年10月25日,江蘇省邳州市公安局以李新德涉嫌「非法經營罪」指定居所監視居住,11月26日轉為刑事拘留,12月5日經邳州市檢察院批准逮捕。其子李超亦被指涉案,與李新德同被監視居住和批捕,2020年10月26日轉取保候審。

On 7 January 2021, a hearing took place in Pizhou City People’s Court of Jiangsu Province. #LiXinde, who exposed official corruption and scandals over the years, was sentenced to five years in prison for the crime of “illegal business operation" (till 9 October 2024) and a fine of RMB 300,000. His son Li Chao was sentenced to one year’s imprisonment and fined RMB 50,000. On 25 October 2019, the Public Security Bureau of Pizhou City, Jiangsu Province placed Li Xinde under “residential surveillance in a designated location” and a month later, he was criminally detained on 26 November 2019, on suspicion of “illegal business operation”. His formal arrest was approved by the Pizhou City Procuratorate on 5 December the same year. His son Li Chao was also accused of being involved in the case and also placed under “residential surveillance in a designated location” and arrested at the same time as Li Xinde. Li Chao was granted bail pending trial on 26 October 2020.

邳州市法院在判決書中稱李新德營運多個網絡平台,為謀取利益,在未核實真偽的情況下,撰寫或者安排其子李超撰寫含有虛假信息的帖文,轉發至其他網站及論壇,形成輿論壓力,向相關單位施壓,意圖為人擺平事端,並收取委託人費用。

李新德表示不服判決,準備上訴。據消息人士報導,李新德兒子李超「認罪認罰」是因為母親去年病危,當局要求李超「認罪認罰」以換取取保候審,否則不給他見母親最後一面。2020年10月26日李超取保候審,兩日後其母病逝。

Li Xinde was engaged in amateur journalism in the 1980s and became a professional reporter in the late 1990s. On 1 October 2003, he founded the China Public Opinion Supervision Network (a website), aiming to fight corruption from the civil society and he is known as “the forerunner of public monitoring in China." With his public monitoring website, Li Xinde conducted public opinion supervision over some 20 senior officials at or above the bureau-director level. The details of corruption of Li Xin (then deputy mayor of Jining City, Shandong Province) and Wang Yachen (mayor of Fuxin City, Liaoning Province) he had disclosed, caused a sensation throughout China. His investigative journalism and outspokenness also caused the website to be blocked many times.

On 25 October 2019, the Public Security Bureau of Pizhou City, Jiangsu Province placed Li Xinde under “residential surveillance in a designated location” and a month later, he was criminally detained on 26 November 2019, on suspicion of “illegal business operation”. His formal arrest was approved by the Pizhou City Procuratorate on 5 December the same year. His son Li Chao was also accused of being involved in the case and also placed under “residential surveillance in a designated location” and arrested at the same time as Li Xinde. Li Chao was granted bail pending trial on 26 October 2020. On 7 January 2021, a hearing took place in Pizhou City People’s Court of Jiangsu Province. It sentenced Li Xinde to five years in prison for the crime of “illegal business operation" (till 9 October 2024) and a fine of RMB 300,000. His son Li Chao was sentenced to one year’s imprisonment and fined RMB 50,000.

On the verdict, the judge states that Li Xinde operated various online platforms for profit, he wrote or arranged for his son Li Chao to write articles containing false information or without verifying the authenticity and share them to other websites and forums. The public opinion puts pressure on relevant parties and Li would collect fees from clients and settle the matter for them.

Li Xinde disagreed with the verdict and planned to appeal. According to an informant, Li Xinde’s son Li Chao, who “pleaded guilty and accepted the verdict" because his mother was critically ill in 2020. The authorities offered Li Chao to “plead guilty and accepted the verdict" in exchange for bail pending trial, otherwise he would not be allowed to see his mother on her deathbed. On 26 October 2020, Li Chao was granted bail pending trial and his mother passed away two days later.
