耿瀟男 — 曾聲援清華大學許章潤教授,「非法經營罪」罪名成立被判刑三年

(更新 9/2/2021)曾聲援清華大學許章潤教授的出版企業家 #耿瀟男 今天(2月9日)於北京海澱區法院被判「非法經營罪」罪名成立判刑三年。她的前夫秦真被判刑兩年半、緩刑三年。耿瀟男也曾為要求習近平下台而遭拘捕的法學學者許志永、律師丁家喜、成都牧師王怡等人呼籲,以及多年來幫助鮑彤、姚監復等著名異見人士。

北京市公安局海澱分局指耿瀟男開設的公司最近十年印刷、銷售非法出版物涉嫌「非法經營」,當時官方認定涉案書籍達8,000冊,涉案金額為16萬元人民幣(2.43萬美元),不久後公安將原來的8,000冊書籍提升至20萬冊,涉案金額也相應提升至數百萬元。這些書籍包括烹飪、營養及養生方面。

外界則認為,當局抓捕耿瀟男與她近年積極參與社會公共活動有關。例如2020年7月6日,清華大學教授許章潤被警察帶走,耿瀟男率先在海外社交平台發布相關消息,為許章潤抱不平。中國公民記者陳秋實在武漢報導2019冠狀病毒疫情失蹤時,耿瀟男也曾為他向外求援。她也曾替要求習近平下台而遭拘捕的法學學者許志永、律師丁家喜、成都牧師王怡等人呼籲。因批評中共而被開除黨籍的中央黨校前教授蔡霞則在推特上透露,多年來耿瀟男還幫助包括鮑彤、姚監復等異議人士。她在2020年7月下旬表示,外出受到便衣公安跟蹤。

2020年9月30日,律師尚寶軍首次在看守所會見耿瀟男,明顯較以往憔悴。耿被拘留初期,幾乎每日接受密集提審,雖然沒有受到肉體上的虐待,但羈押在一個20人的牢房,已是一種折磨。2020年12月1日,尚律師再次會見耿瀟男,得知辦案單位上個月密集提審耿瀟男,以人身攻擊甚至辱罵逼迫她認罪,又將她調至另一個牢房,遭到「新獄友」霸凌,拘押待遇惡化。

2020年12月7日報導,獨立中文筆會將本年度「林昭紀念獎」授予耿瀟男,以表揚她明知危險仍不畏懼的勇氣,並呼籲中共當局立即無條件釋放耿瀟男。

2021年1月13日,律師尚寶軍前往探望耿瀟男時,被當局告知耿已解聘了他。據悉當局向耿瀟男表示,給予她最輕處罰的前提是解聘曾經代理劉曉波、高瑜等案件的著名人權律師尚寶軍。此案將於2月9日在北京市海淀區人民法院審理。據猜測,選擇在春節前開庭,是希望趁節假日淡化大眾的關注及減少前來法院聲援的人數。

Description:
The Haidian Branch of the Beijing Municipal Public Security Bureau first alleged Geng’s company with being involved in illegal publications of 8,000 books in the past ten years, with an amount involved of 160,000 Yuan (approximately equal to USD 24,300). However, the public security increased the original 8,000 volumes to 200,000 volumes shortly afterwards, and the amount involved in the case also increased to several million yuan. The so-called illegal publications involved cooking, nutrition and health issues.

It is believed the charge is simply a cover-up. What led to her detention is her active participation in social and civil society activities in recent years. On 6 July 2020, Xu Zhangrun, a professor at Tsinghua University who was outspoken in pointing out current issues and criticizing authorities, was taken away by the police. Geng Xiaonan was the first to publish related news on overseas social platforms, advocating for the release of Xu Zhangrun and posted an article to show support for Xu after Tsinghua University fired him. When the Chinese citizen reporter Chen Qiushi went missing while reporting the COVID-19 pandemic in Wuhan in February 2020, Geng Xiaonan sought help for him. She also appealed on behalf of the legal scholar Xu Zhiyong (who wrote an open statement, asking Xi Jinping to step down), lawyer Ding Jiaxi, and Chengdu pastor Wang Yi. Cai Xia, a former professor at the Central Party School who was expelled from the CCP for criticizing the CCP, revealed on Twitter that Geng Xiaonan had also helped dissidents including Bao Tong and Yao Jianfu over the years. Geng also said in late July that she was followed by plainclothes police when she went out.

On 30 September 2020, Lawyer Shang Baojun visited Geng Xiaonan in the detention centre for the first time. He pointed out that she was obviously more haggard than before. In the first days of her detention, Geng faced intensive interrogation daily. Although she was not physically abused, she had to live with 20 people in a room and it felt like torture to her. On 1 December, when Lawyer Shang visited Geng again, he learned that the authority handling the case had intensively interrogated Geng Xiaonan the previous month, forced her to confess with personal insults. She was even transferred to another cell, where the “new inmates" bullied her. In general, the conditions in the detention centre deteriorated.

On 7 December, the Independent Chinese PEN Center announced that this year’s “Lin Zhao Memorial Award" was awarded to Geng Xiaonan, in recognition of her courage in speaking out for justice without regarding for her own safety, and called on the Chinese authorities to immediately and unconditionally release Geng Xiaonan. Lin Zhao Memorial Award is to commemorate a Mao-era dissident who was executed after continuing to write in prison using her own blood as ink.

On 13 January 2021, when Lawyer Shang went to visit Geng in the detention centre, the authorities told him that Geng had dismissed him. According to other news sources, the authorities told Geng that she must dismiss Lawyer Shang in order to exchange for the most lenient punishment. Lawyer Shang Baojun is a well-known human rights lawyer who represented Liu Xiaobo, Gao Yu and many others. The trial will take place in Beijing Municipality Haidian District People’s Court on 9 February 2021, right before the Chinese new year. It is believed that the authorities chose the date carefully, hoping that it would attract less public attention and reduce the number of people who come to the court to show support.

2021年2月2日 #沈良慶 一案終於開庭審訊,未有當庭判罪。沈良慶在自辯時控訴在被關押期間受到不人道對待。2019年4月23日,沈良慶在推特上張貼他與日本記者的合照,並說記者是專程到合肥訪談 #六四 的話題,他介紹了自己經歷的本地學潮情況。
5月15日,他被公安從家中帶走,並以涉「尋釁滋事罪」被刑事拘留。2019年6月20日他被正式拘捕,10月24日被起訴。沈良慶長年關注人權和民主議題,包括香港的「#雨傘運動」和「#反送中」運動。

Shen Liangqing was finally tried on 2 February 2021 but no verdict was delivered. In his own defense, Shen said he was ill-treated during detention. On 23 April, 2019, Shen Liangqing posted a photo of him with a Japanese reporter on Twitter, saying that the reporter had made an extra trip to Hefei to cover the 30th anniversary of #June4 Massacre, and he told the journalist about the student movement he had experienced. On 15 May, he was taken away by the police and was then criminally detained, on suspicion of “picking quarrels and provoking trouble." He was formally arrested on 20 June 2019 and indicted on 24 October the same year. Shen has been concerned about human rights and democracy issues for many years, including #HongKong’s #UmbrellaMovement and #AntiExtraditionBill protests.

據起訴書稱,自2017年至2019年5月被抓捕這段期間,沈良慶利用信息網絡,運用相關軟件,通過推特、臉書等境外社交平台發布貼文,獲關注粉絲2萬餘人。

起訴書還稱,沈良慶所發貼文中,有一部分是通過「歪曲」歷史事件性質、社會敏感熱點等內容,編造「虛假信息」,攻擊、破壞正常社會秩序。

他的代表律師劉浩在沈良慶家屬的陪同下,2019年5月底會見了沈良慶,了解到沈良慶遭拘留初期,被戴上黑頭套、24小時禁止吃喝、禁止去廁所,並被疲勞審訊等酷刑,而審訊內容主要涉及六四和他接受外媒採訪等。

2019年中,國保亦到看守所找沈良慶談話,要求他解除與家屬聘請的律師協議,由官方指定的律師辯護。國保的理由是沈家家庭貧困,貧困戶屬於符合申請法律援助的條件。沈良慶表示堅決不辭退家屬委託的律師。其次堅決不用官方指定的官派律師。如果非用不可,他就拒絕用律師,直接自行辯護。

這次被長期扣留及久未開庭,除了因為他接受外媒訪問談及六四及經常評論中共黨務,另一位熟悉沈良慶的朋友猜測,2014年香港佔中時期,沈良慶曾剃光頭舉牌拍照聲援港人,結果被刑事傳喚和抄家。2019年香港發生大規模反修例示威,考慮到他的敢言作風,當局覺得更有必要囚禁著他。

Description:

Shen Liangqing graduated from the Chinese Department of Anhui University in July 1984. Between July 1984 and April 1992, he worked as a prosecutor in the Anhui Provincial Procuratorate. In 1984, he founded an independent journal “College Students and Society" to promote freedom, human rights and other universal values. Due to his involvement in the June 4th student movement, he was sentenced by the court in Hefei City in 1992 for “inciting subversion of state power" for 18 months of imprisonment, and lost his job as a prosecutor.

After he was released from prison, he has been a vocal critic on social affairs, voicing for vulnerable people (such as Zhang Anni, daughter of a political prisoner, who was deprived from her right to education ), commenting on the internal affairs of the Communist Party by using his identity of former prosecutor. Therefore, he has been put under surveillance, detention, house arrest, and his mobile phones and computers have been repeatedly confiscated.

On 23 April, 2019, Shen Liangqing posted a photo of him with a Japanese reporter on Twitter, saying that the reporter had made an extra trip to Hefei to cover the 30th anniversary of June 4th Massacre, and he told the journalist about the student movement he had experienced. According to the indictment, Shen Liangqing used network and related softwares to post on Twitter, Facebook and other overseas social platforms, attracted more than 20,000 followers between 2017 and May 2019. It states that some of Shen Liangqing’s posts were to fabricate “false information" by “distorting" the nature of historical events, sensitive social topics and etc., in order to disrupt social order.

In late May 2019, Lawyer Liu Hao, accompanied by Shen Liangqing’s family, met with Shen Liangqing. He learned that in the beginning of the detention, Shen Liangqing suffered from torture, including being hooded, prohibited from eating and drinking for 24 hours, prohibited from going to the toilet, and forced to go through continuous interrogation. The interrogation was mainly about June Fourth and his interviews with foreign journalists.

In mid-2019, the state security officers tried to persuade Shen to dismiss his own lawyer and to be represented by the lawyer appointed by the authorities. The sate security officers claimed that Shen’s family is poor and the poor households are eligible for legal aid. Shen Liangqing refused to dismiss the lawyer entrusted by his family and declined any officially appointed lawyers. Shen said he would be prepared to defend himself without any lawyers, if the authorities would force him to accept lawyers they appoint.

Despite his interviews with foreign media about June Fourth and frequent criticisms against the Communist Party, his long detention without trials could be interpreted as a way to stop him from voicing for the Hong Kong protesters. Back in 2014, Shen shared a picture of himself, who shaved his head and held up a placard to support Hong Kong protesters during the Umbrella Movement. He was then summoned by the authorities and his home was ransacked. In 2019, the Hong Kong people launched large-scale protests to fight against the amendments of the extradition bill. Considering his courageous style, the authorities might feel that it was better to detain him, in order to silence him.

On 30 November 2020, #OuBiaofeng used his Twitter account (@oubiaofeng) to retweet “Splash-ink Girl” Dong Yaoqiong’s video calling for help. On 3 December, Ou Biaofeng was taken away from his home in Ningxiang, Hunan, by state security police officers. Ou Biaofeng was originally administratively detained for 15 days for “picking quarrels and provoking trouble” but he was placed under “residential surveillance in a designated location” for “inciting subversion of state power” when the administrative detention was supposed to end. Ou Biaofeng consistently supported other human rights defenders detained or persecuted by the Chinese authorities and provided assistance to them, including deceased Hunan “June 4th” and labour activist Li Wangyang and Dong Yaoqiong, who was known as the “Splash-Ink Girl” after she splashed ink on a portrait of Chinese President Xi Jinping as a protest and was sent to mental hospital twice. 魏歡歡為歐彪峰聘請的律師張磊和李貴生曾嘗試會見歐彪峰,但均遭到公安無理拒絕。2020年12月30日,株州市公安局致函李貴生律師,聲稱李貴生律師因作為本案證人,與歐彪峰一案的審理結果有利害關係為由,意圖強行解除他的辯護人資格,李貴生律師表示不同意公安的觀點,並於2021年1月6日以其律師信函回覆公安局表示李貴生律師並非本案證人,並促請當局依法辦案。但公安局一直沒有回覆。

魏歡歡於2021年1月12日於幼兒園工作下班的時候,突然遭到園長告訴她不用再去上班,其後更對她各種刁難令她難堪逼她辭職。她與歐彪峰育有兩名分別三歲多和兩歲多的男孩。

Description:

Ou Biaofeng, using his Twitter account (@oubiaofeng), consistently supported other human rights defenders detained or persecuted by the Chinese authorities and provided assistance to them, including deceased Hunan “June 4th” and labour activist Li Wangyang and Dong Yaoqiong, who was known as the “Splash-Ink Girl” after she splashed ink on a portrait of Chinese President Xi Jinping as a protest and was sent to mental hospital twice. Ou Biaofeng also showed support to the “Anti-Extradition Bill” protests in Hong Kong in 2019.

On 30 November 2020, Ou Biaofeng retweeted Dong Yaoqiong’s video calling for help. On 3 December 2020, Ou Biaofeng was taken away by state security police officers from his home in Ningxiang in Hunan province. The state security police officers told Ou Biaofeng’s wife Wei Huanhuan that Ou was administratively detained for 15 days for “picking quarrels and provoking trouble”. But Wei only learned from Ou’s mother that she received the notification of administrative detention from Zhuzhou City Public Security on 8 December. Before the administrative detention ended on 18 December 2020, Ou Biaofeng was placed under “residential surveillance in a designated location” and his offence was changed to “inciting subversion of state power”. Only until 25 December 2020, Wei Huanhuan received the notification of “residential surveillance in a designated location” from Zhuzhou City Public Security Bureau.

Lawyers Zhang Lei and Li Guisheng, who were hired by Wei Huanhuan to represent Ou Biaofeng, had requested to meet Ou but the public security officers rejected their requests without any sound reasons. On 30 December 2020, Zhuzhou City Public Security Bureau sent a letter to Lawyer Li Guisheng, attempting to strip off his qualification to legally represent Ou, claiming that Li Guisheng was a witness of Ou Biaofeng’s case and there would be conflict of interest if he represented Ou. Li Guisheng did not agree with the public security and sent a formal written reply under his law firm’s name to the public security bureau on 6 January 2021 arguing that Li Guisheng was not a witness of the case and urging the public security bureau to handle the case in accordance with the laws. But the public security security has not given any reply.

李懷慶原重慶市民營企業富華典當有限公司董事,熱心捐助弱勢社群,2017年底參與一個慈善活動,參與者太多為民營企業家和知名學者,其間討論到公安部貪腐問題。2018年1月,與公司幾名員工被公安帶走,李懷慶先被控「虛假訴訟罪」,至2019年1月又以「非法拘禁罪、詐騙罪、敲詐勒索罪和煽動顛覆國家政權罪」正式起訴,至2020年11月被重判20年,全數資產被凍結。李懷慶8名員工也被判處4年至16年不等。李懷慶妻子包艷表示會上訴。

Li Huaiqing was the director of a private enterprise in Chongqing. He’s famous for donating to help the underprivileged. In late 2017, while taking part in a charity event, participants – mostly private entrepreneurs and famous scholars – discussed the corruption problems of the Ministry of Public Security. In January 2018, Li and several staff from his company were taken away by the police. Li was first accused of “false litigation”. Until January 2019, Li was indicted for “false imprisonment, fraud, extortion and inciting subversion of state power”. At last, he was sentenced to 20 years imprisonment and all his assets frozen in November 2020. Eight of Li’s employees were also sentenced to jail, ranging from 4 to 16 years. His wife Bao Yan said they would appeal.

李懷慶是重慶市民營企業富華典當有限公司的董事長,長期熱心公益事業。據李懷慶的太太包艷表示,李長期關注和資助弱勢群體,曾多年資助大涼山地區貧困兒童和家境困難的昔日當兵時的戰友,並參與救助塵肺病工人的「大愛清塵」活動,先後捐資三十萬元人民幣。

2017年底,他在杭州參加了「公和基金會」組織的慈善活動,期間大家談到公安部的貪腐問題。與會者建議將所掌握的情況用書信形式向習近平反映。由於與會者大多是上市公司老總和知名學者,公安部有所顧忌,於是將報復目標鎖定在李懷慶等民營企業家身上,以起到殺一儆百的作用。

2018年1月31日李和數名員工被公安抓走。2018年2月2日被重慶巿公安局刑事拘留,涉嫌「虛假訴訟罪」,2018年2月12日被正式逮捕。同年7月12日,重慶巿公安局以被告涉嫌「煽動顛覆國家政權罪」,向重慶巿江北區人民檢察院移送審查起訴。後者將案件在同月24日移交重慶巿人民檢察院第一分院審查起訴。第一分院以證據不足,事實不清為由,兩度發還案件至公安局作補充偵查,至2019年1月30日以「非法拘禁罪、詐騙罪、敲詐勒索罪和煽動顛覆國家政權罪」正式起訴李。當局同時凍結李懷慶、他的公司及他姐姐(未有涉及任何案件)的資產,涉及過億元人民幣。

李懷慶被指控在2017年10月至2018年1月間,在微信「以造謠、誹謗等方式煽動顛覆國家政權」七次發文,包括轉發文章「紅四方面軍在四川殺人百萬」及涉及「道義抗爭」、「暴力革命」等內容的錄音。這些微信訊息是李轉發給大兒子的私信,還有跟朋友聊天的內容。李太太表示「就是私底下的聊天,就讓他們作為證據,說他煽動顛覆國家政權。」。

羈押過程中,李懷慶的律師及其家屬均未收到涉嫌「煽動顛覆國家政權罪」的逮捕通知書或文件。案件於2020年6月8日在重慶市第一中級法院開庭審理,但沒有當庭宣判。法庭指由於疫情,限制李懷慶一方最多只能有兩名相關人員出庭。他的妻子包艷認為,法院是利用疫情做幌子 ,故意阻撓相關人員出庭作證。

2020年11月20日,李被判處有期徒刑20年,剝奪政治權利3年,名下資產全數凍結。李懷慶8名員工也被判處徒刑,刑期4年至16年不等。包艷表示會上訴。

Description:
Li Huaiqing is the director of the Chongqing private enterprise Fuhua Pawn Co., Ltd., and a prominent philanthropist. According to Li Huaiqing’s wife Bao Yan, Li has been caring for and funding disadvantaged groups. Over the years, he has subsidized poor children in the Daliangshan area and former comrades from the army who were in financial difficulties, volunteered for Da-ai-qing-chen (an organization to support migrant workers who contracted silicosis from workplace). He has donated about 300,000 yuan in total.

In late 2017, he participated in a charity event organized by the “Gonghe Foundation" in Hangzhou city, during which participants talked about corruption in the Ministry of Public Security. Participants suggested that they should report this problem to Xi Jinping by writing him letters. Ministry of Public Security got wind of this meeting and decided to punish private entrepreneurs such as Li Huaiqing as retaliation, while most of the other attendees were CEOs of listed companies and well-known scholars.

On 31 January 2018, Li and several employees were taken away by the police. He was criminally detained by the Chongqing Public Security Bureau on 2 February 2018, on suspicion of “false litigation", and was formally arrested on 12 February 2018. On 12 July of the same year, the Chongqing Public Security Bureau transferred his case to the People’s Procuratorate of Jiangbei District for review and prosecution on suspicion of “inciting subversion of state power." The latter further transferred the case to the First Branch of the Chongqing Municipal People’s Procuratorate for review and prosecution on 24 July 2018. On the grounds of insufficient evidence and unclear facts, it twice sent the case back to the Public Security Bureau for supplementary investigation. It was until 30 January 2019 that Li was formally charged with “false imprisonment, fraud, extortion and inciting subversion of state power". The authorities also freezed the assets of Li Huaiqing, his company and his sister (who has not involved in any cases), involving more than 100 million yuan.

Li Huaiqing was accused of “inciting subversion of state power by spreading rumors and slander" on WeChat in seven occasions between October 2017 and January 2018, including re-posting an article called “Fourth Red Army Killed Millions in Sichuan"*, sending audio clips including phrases such as “moral resistance", “violent revolution" to others. These WeChat messages are indeed private messages that Li forwarded to his eldest son and chats with his friends. Mrs. Li said that “those are simply private chats and are now used as evidence that he incited subversion of state power."

During detention, neither Li Huaiqing’s lawyers nor his family received an arrest notice or document stating that he “incited subversion of state power." The case was heard in Chongqing No. 1 Intermediate People’s Court on 8 June 2020, but no verdict was pronounced on that day. The court stated that due to the COVID-19 [andemic, the number of Li Huaiqing’s witnesses to testify in court was restricted to a maximum of two persons. His wife Bao Yan believes that the court was using the pandemic as an excuse to deliberately obstruct relevant personnel from testifying for Li.

Li was sentenced to 20 years in prison, deprived of political rights for 3 years, and all assets under his name were frozen on 20 November 2020. Eight employees of Li Huaiqing were also sentenced to imprisonment, ranging from 4 to 16 years. His wife said they would appeal.

*Li is not the original author of this article. The article he shared stated that in the autumn of 1932, the Fourth Army led by Zhang Guotao brought more than 20,000 soldiers to northern Sichuan. According to the “Sichuan Monthly", the Red Army massacred the local people and caused a total causality of 1.1 million.

陳杰人因為在網上公開實名舉報湖南省邵陽市紀委書記鄧廣雁嚴重失職瀆職等問題,被控「尋釁滋事、敲詐勒索、非法經營、行賄」等四罪。2020年4月30日一審宣判,陳杰人被判有期徒刑15年,罰金701萬元,刑期至2033年6月24日。弟弟陳偉人也被控以「尋釁滋事罪、敲詐勒索罪」判刑4年;陳杰人前妻劉敏被控「尋釁滋事罪」,免予刑罰。

Chen Jieren graduated from the Law School of Tsinghua University in 2001, later joined a number of media agencies and is known for his outspokenness. He has been repeatedly suppressed for exposing social problems and even official corruption while working in the state-owned media agencies. In 2003, he was fired from the China Youth Daily for reporting a prostitution ring involving college students in Wuhan which caused a scandal; in 2005, he was fired for publishing a critical article which upset the authorities when he was the editor-in-chief of China Philanthropy Times; in October 2011, People’s Daily removed him from his post as executive editor of its Jiangsu Province division, due to writing “too much criticism against the government". Since 2015, he has been seen as a thorn in the eye of authorities for his outspoken political commentaries on Weibo (microblog) and other media platforms. On 25 June 2018, he lost contact from others after he publicly reported on the internet that Deng Guangyan, Secretary of the Discipline Inspection Commission of Shaoyang City, Hunan Province had committed professional misconduct and serious dereliction of duty. On 4 July 2018, he was formally detained by Hunan police on suspicion of “extortion, illegal business operations” and other offenses. His wife, two brothers and two assistants were also detained. Later, the local procuratorate prosecuted him for the same offences. Chen was accused of using his identity as a “famous blogger" to publish false or negative information that “sabotaged the reputation of the Party and the government and damaged the government’s reputation”. His family members have been accused of forming “a criminal gang that uses the internet to commit the offenses."

One month after Chen Jieren’s detention, China Central Television broadcast a video clip of his confession. In the video, Chen Jieren admitted that he wrote articles to make and cheat money in the name of “public monitoring”. On 16 August 2018, the official mouthpiece Xinhua News Agency published a long article entitled “From “famous blogger" to “Internet Pest", claiming that Chen Jieren had opened multiple social media accounts and published more than 3,000 articles in order to make money in the name of “public monitoring".

Observers and Chen Jieren’s defense lawyer believe that he was forced to conduct a televised confession and it was not a fair trial, which is a tactic often used by the Chinese government. In particular, Chen Jieren’s high-profile real-name complaint against officials angered the authorities. He was singled out and his punishment would be harsh, as a deterrent. Lawyer Liu Hui stated that since the case was filed in July 2018, Chen Jieren had not been allowed to meet with his lawyer.

The first hearing took place in Guiyang County People’s Court in Hunan in November 2019. The charges against him were “picking quarrels and provoking trouble, extortion, illegal business operations and bribery". The verdict was finally delivered on 30 April 2020, with Chen being sentenced to 15 years in prison with a fine of 7.01 million yuan. His long sentence will expire on 24 June 2033. 李孟居 – 支援香港「反送中」後失聯;失蹤年多後,被指涉嫌為境外刺探、非法提供國家秘密罪

2019年8月18日,#李孟居 從台灣到香港支援「反送中」運動。8月20日,李孟居從香港入境深圳。當日對在台友人表示中國解放軍集結在邊境,情勢看來很緊張,他想過關到深圳,並傳送一張關於解放軍集結照片給友人,此後,李孟居與外界失去聯絡。失蹤一年多後,2020年10月11日,中國中央電視台《焦點訪談》詳細介紹「李孟居案」及所謂台獨組織「台灣聯合國協進會」。節目抹黑李孟居是「別有用心的商人」。被強迫失蹤一年多更沒有符合法律規定保障,但央視在節目中卻播出李孟居所謂「認罪」。

Li Mengju travelled from Taiwan to Hong Kong on 18 August 2019, to show his support to the Hong Kong protesters in their demonstrations against the extradition bill. On 20 August 2019, he told his friend that the Chinese army had assembled at the Hong Kong-Shenzhen border and the situation was tense. He expressed his wish to go to Shenzhen and sent a photo of the Chinese army to his friend and went missing. On 11 October 2020, Chinese national broadcaster China Central Television (CCTV) revealed the details of Li’s case and the involvement of a so-called “Taiwan Independence" force after a year of Li’s forced disappearance. The show accused Li as “a businessman with certain other intentions". Li was forcibly disappeared for over one year without any legal protection as the Chinese authorities didn’t follow proper legal procedures, but the CCTV programme broadcast his so-called “confession”.

2019年9月11日,中國的國務院台灣事務辦公室發言人稱李孟居因涉嫌從事危害國家安全的犯罪活動,已被依法審查,但未披露具體的經辦單位。 11月30日《廣州日報》報導,此前的10月31日,經深圳市人民檢察院批准,李孟居因涉嫌為境外刺探、非法提供國家秘密罪,被深圳市國家安全局逮捕。

失蹤一年多後,2020年10月11日,中國中央電視台《焦點訪談》節目詳細介紹了李孟居一案以及所謂的台獨組織「台灣聯合國協進會」。節目指李是個「別有用心的商人」,2019年到香港支援「黑衣暴徒」後,前往深圳灣體育場偷拍武警集結的情況,被警方喝斥後仍持續偷拍,意圖錄下武警操練的聲音。他於8月20日往深圳碼頭離境時,被國家安全機關抓捕。他在節目中「認罪」:「我真的很抱歉啊。過去做了很多不好的錯事,對祖國對國家或許有一些傷害。」

台灣陸委會對該節目內容回應道,此事為惡意政治炒作,誣陷台灣人民從事間諜行為。

從李被捕一年多來,中國未落實國際法上對於刑事逮捕程序、刑事被告的公平審判權,被告與家人及律師聯繫及見面的權利。李孟居在未享有人權保障的情況下,錄製自白及認罪影片,完全不符合司法程序。

Description:
Li Mengju travelled from Taiwan to Hong Kong on 18 August 2019, to show his support to the Hong Kong protesters in their demonstrations against the extradition bill. On 20 August 2019, he told his friend Chen Yalin (aka Archer Chen) in Taiwan, who is the chief of Fangliao Township, that the Chinese army had assembled at the Hong Kong-Shenzhen border and the situation was tense, he expressed his wish to go to Shenzhen, sent a photo of the Chinese army to Chen and went missing. According to the Chinese media reports much later, Li was detained by the national security officers when he wanted to leave China from Port of Shenzhen. On 25 August 2019, Chen Yalin sought help from Taiwan’s Mainland Affairs Council, as he could not reach Li since 20 August. Chen also contacted Shenzhen Municipal Public Security Bureau, which claimed that it did not have any information regarding Li Mengju’s entry to Shenzhen and asked him to contact the Hong Kong Police. On 28 August 2019, Taiwan’s Mainland Affairs Council confirmed Li’s disappearance.

On 11 September 2019, a spokesperson of the Taiwan Affairs Office, under the State Council of China stated that Li Mengju had been suspected of engaging in criminal activities which endanger national security, and therefore was under investigation in accordance with law. However, he did not disclose which department was in charge of it. On 30 November 2019, Guangzhou Daily reported that on 31 October, the Shenzhen Municipal People’s Procuratorate had approved the Shenzhen National Security Bureau’s application to formally arrest Li Mengju, on suspicion of spying for and illegally providing state secrets to a foreign entity.

On 11 October 2020, Chinese national broadcaster China Central Television (CCTV) revealed the details of Li’s case and the involvement of a so-called “Taiwan Independence" force after a year of Li’s forced disappearance. The show accused Li as “a businessman with certain other intentions", who went first to Hong Kong to support the “black-clad rioters" and then to Shenzhen Bay Sports Center to film the assembly of paramilitary armed police. It is reported that after being told to stop by the police, Li continued to film as he wanted to record the sound of the police assembly. Li was detained on the same day, as he was leaving China via the Port of Shenzhen. On CCTV, Li confessed: “I’m very sorry, and I feel that I have done a lot of wrong things that may have harmed the country.”

Taiwan’s Mainland Affairs Council commented that the accusations are purely “malicious political stunt” from the Chinese side, “falsely accusing our people of espionage” and “harming the relations between the two sides,” in a statement.

Since Li’s detention, China has not followed the international standards regarding criminal procedure, has not respected Li’s rights to a fair trial, to contact or meet his family and lawyer. The so-called television confession was made under the violations of these basic human rights and is entirely incompatible with the judicial procedure.
