On 23 March 2021, the court hosted a video conference to deliver Zhang Wuzhou’s verdict. She is found guilty for both offences and sentenced to 2.5 years imprisonment, till 5 December 2022. The court muted her voice and her son said he could only hear her saying, “you sentence me to 2 years 6 months, I will keep fighting for the truth." Zhang has suffered from torture repeatedly since her detention. During Christmas (25-27 December 2020), she was forced to wear shackles and handcuffs again. She reported to the authorities of the physical pain she could hardly bear and asked for a nuclear magnetic resonance spectroscopy to get a clearer diagnosis. Instead of providing her medical treatment, the authorities only gave her some painkillers. Zhang’s family hopes that the public would continue to follow the case and speak out for her.

Description:
Originally from Hubei Province, Zhang Wuzhou became a human rights activist after her younger brother Zhang Liumao’s mysterious death in Guangdong Province. Zhang Liumao died in Guangzhou No. 3 Detention Centre after being detained for “picking quarrels and provoking trouble". Since then, Zhang Wuzhou kept demanding an answer from the authorities and started to get involved in other human rights activities.

On 20 September 2018, when Lawyer Sun Shihua was handling a case at Hualin Police Station in Liwan District, Guangzhou, police assaulted her and insulted her by forcing her to go through a strip search. Zhang Wuzhou and Liang Songji were accompanying Lawyer Sun and witnessed the whole incident. They later made a public testimony online to support Sun Shihua’s accusation against the police. As retaliation, the Guangzhou police arrested Zhang and Liang for “picking quarrels and provoking trouble". Liang was sentenced to one year and six months and Zhang Wuzhou was sentenced to one year and four months. Zhang was released from prison on 14 February 2020, after serving her sentence.

On 4 June 2020, Zhang posed for photos at Guangdong’s Baiyunshan scenic area on the 31st anniversary of the Tiananmen massacre, holding up slogans that read “Don’t forget June 4th, withdraw the draconian law" as to oppose Beijing’s plan to impose draconian sedition legislation on Hong Kong and “lawyer was assaulted and her witness became a beggar” regarding her own case. She then uploaded the photos to her WeChat account and some other WeChat groups.

The Qingyuan City Police took Zhang Wuzhou away from her home on the grounds of disturbing public order in the afternoon of 5 June 2020. The next day she was transferred to criminal detention for “picking quarrels and provoking trouble" and detained in the Qingxin District Detention Centre. On 20 June, she was formally arrested and on 19 August 2020, she was indicted for “picking quarrels and provoking trouble" and “obstructing official duties".

Zhang’s younger sister said she was contacted by a certain lawyer named Zhu, offering to provide free legal aid to Zhang, claimed that she visited Zhang in the detention center and Zhang was calm and in good conditions. Zhang’s sister did not trust this lawyer and employed Lawyer Huang Simin instead.

On 22 July, Zhang Wuzhou was finally allowed to meet with the lawyer hired by her family. She told Lawyer Huang that she was tortured in the detention centre. From 7 June to 12 June, she was forced to wear shackles weighted over 100 catties and they were interlocked with her handcuffs. Therefore, she had to bend and twist her body like a ball for six days and she was in deep pain. Moreover, she was beaten by other prisoners in her cell.

The first hearing took place on 24 November 2020. Only Zhang’s son was allowed to attend, while her friends who came to support her were taken away by the state security police officers. Zhang maintained that she did not break any laws and her lawyer defended her in cour that Zhang’s behaviour was only to exercise her freedom of speech. However, the judge told the lawyer not to mention the “unrelated matters". No verdict has been delivered after this hearing.

On 23 March 2021, the court hosted a video conference to deliver her verdict. She is found guilty for both offences and sentenced to 2.5 years imprisonment, till 5 December 2022. The court muted her voice and her son said he could only hear her saying, “you sentence me to 2 years 6 months, I would keep fighting for the truth."

Publisher #GengXiaonan who supported Tsinghua University professor Xu Zhangrun has been sentenced to 3 years in prison for “illegal business operation". Her former husband Qin Zhen was sentenced to 2.5 years, suspended for three years. #GengXiaonan had called for the release of legal scholar Xu Zhiyong, lawyer Ding Jiaxi and Chengdu Christian pastor Wang Yi. Over the years, she also supported prominent dissident like Bao Pu and Yao Jianfu.

(Geng Xiaonan)

Name: Geng Xiaonan (耿瀟男)

Date of birth: 16 April 1974
Occupation: Publisher, independent TV producer, entrepreneur, current director of Legend Tianhui Film and Television Culture (Beijing) Co., Ltd.

Date of detention: 9 September 2020
Location: Police detained her and her former husband Qin Zhen in Beijing.
Ground of detention: Beijing police put her in criminal detention on suspicion of “illegal business operation" for “printing and selling illegal publications"

Date of formal arrest: Formal arrest approved by Beijing’s Haidian District Procuratorate on suspicion of “illegal business operation” on 15 October 2020. The case has been passed on to Haidian District Procuratorate for further investigation and indictment on 14 December 2020.

Date of Indictment: On 29 January 2021 her lawyer received the indictment)

Legal representation: Lawyer Shang Baojun (on 13 January 2021, Lawyer Shang was informed that Geng had dismissed him), Lawyer Qu Zhenhong

Date of trial: On 9 February 2021 the trial will take place in Beijing Municipality Haidian District People’s Court
Date of sentencing:
Verdict:
Sentence:
Location of detention/imprisonment: Beijing’s Haidian District Detention Centre

Description:
The Haidian Branch of the Beijing Municipal Public Security Bureau first alleged Geng’s company with being involved in illegal publications of 8,000 books in the past ten years, with an amount involved of 160,000 Yuan (approximately equal to USD 24,300). However, the public security increased the original 8,000 volumes to 200,000 volumes shortly afterwards, and the amount involved in the case also increased to several million yuan. The so-called illegal publications involved cooking, nutrition and health issues.

It is believed the charge is simply a cover-up. What led to her detention is her active participation in social and civil society activities in recent years. On 6 July 2020, Xu Zhangrun, a professor at Tsinghua University who was outspoken in pointing out current issues and criticizing authorities, was taken away by the police. Geng Xiaonan was the first to publish related news on overseas social platforms, advocating for the release of Xu Zhangrun and posted an article to show support for Xu after Tsinghua University fired him. When the Chinese citizen reporter Chen Qiushi went missing while reporting the COVID-19 pandemic in Wuhan in February 2020, Geng Xiaonan sought help for him. She also appealed on behalf of the legal scholar Xu Zhiyong (who wrote an open statement, asking Xi Jinping to step down), lawyer Ding Jiaxi, and Chengdu pastor Wang Yi. Cai Xia, a former professor at the Central Party School who was expelled from the CCP for criticizing the CCP, revealed on Twitter that Geng Xiaonan had also helped dissidents including Bao Tong and Yao Jianfu over the years. Geng also said in late July that she was followed by plainclothes police when she went out.

On 30 September 2020, Lawyer Shang Baojun visited Geng Xiaonan in the detention centre for the first time. He pointed out that she was obviously more haggard than before. In the first days of her detention, Geng faced intensive interrogation daily. Although she was not physically abused, she had to live with 20 people in a room and it felt like torture to her. On 1 December, when Lawyer Shang visited Geng again, he learned that the authority handling the case had intensively interrogated Geng Xiaonan the previous month, forced her to confess with personal insults. She was even transferred to another cell, where the “new inmates" bullied her. In general, the conditions in the detention centre deteriorated.

On 7 December, the Independent Chinese PEN Center announced that this year’s “Lin Zhao Memorial Award" was awarded to Geng Xiaonan, in recognition of her courage in speaking out for justice without regarding for her own safety, and called on the Chinese authorities to immediately and unconditionally release Geng Xiaonan. Lin Zhao Memorial Award is to commemorate a Mao-era dissident who was executed after continuing to write in prison using her own blood as ink.

On 13 January 2021, when Lawyer Shang went to visit Geng in the detention centre, the authorities told him that Geng had dismissed him. According to other news sources, the authorities told Geng that she must dismiss Lawyer Shang in order to exchange for the most lenient punishment. Lawyer Shang Baojun is a well-known human rights lawyer who represented Liu Xiaobo, Gao Yu and many others. The trial will take place in Beijing Municipality Haidian District People’s Court on 9 February 2021, right before the Chinese new year. It is believed that the authorities chose the date carefully, hoping that it would attract less public attention and reduce the number of people who come to the court to show support.

Location of detention/imprisonment: Unknown

Description:
Chen Jieren graduated from the Law School of Tsinghua University in 2001, later joined a number of media agencies and is known for his outspokenness. He has been repeatedly suppressed for exposing social problems and even official corruption while working in the state-owned media agencies. In 2003, he was fired from the China Youth Daily for reporting a prostitution ring involving college students in Wuhan which caused a scandal; in 2005, he was fired for publishing a critical article which upset the authorities when he was the editor-in-chief of China Philanthropy Times; in October 2011, People’s Daily removed him from his post as executive editor of its Jiangsu Province division, due to writing “too much criticism against the government". Since 2015, he has been seen as a thorn in the eye of authorities for his outspoken political commentaries on Weibo (microblog) and other media platforms. On 25 June 2018, he lost contact from others after he publicly reported on the internet that Deng Guangyan, Secretary of the Discipline Inspection Commission of Shaoyang City, Hunan Province had committed professional misconduct and serious dereliction of duty. On 4 July 2018, he was formally detained by Hunan police on suspicion of “extortion, illegal business operations” and other offenses. His wife, two brothers and two assistants were also detained. Chen was accused of using his identity as a “famous blogger" to publish false or negative information that “sabotaged the reputation of the Party and the government and damaged the government’s reputation”. His family members have been accused of forming “a criminal gang that uses the internet to commit the offenses."

One month after Chen Jieren’s detention, China Central Television broadcast a video clip of his confession. In the video, Chen Jieren admitted that he wrote articles to make and cheat money in the name of “public monitoring”. On 16 August 2018, the official mouthpiece Xinhua News Agency published a long article entitled “From “famous blogger" to “Internet Pest", claiming that Chen Jieren had opened multiple social media accounts and published more than 3,000 articles in order to make money in the name of “public monitoring".

Observers and Chen Jieren’s defense lawyer believe that he was forced to conduct a televised confession and it was not a fair trial, which is a tactic often used by the Chinese government. In particular, Chen Jieren’s high-profile real-name complaint against officials angered the authorities. He was singled out and his punishment would be harsh, as a deterrent. Lawyer Liu Hui stated that since the case was filed in July 2018, Chen Jieren had not been allowed to meet with his lawyer.

The first hearing took place in Guiyang County People’s Court in Hunan in November 2019. The charges against him were “picking quarrels and provoking trouble, extortion, illegal business operations and bribery". The verdict was finally delivered on 30 April 2020, with Chen being sentenced to 15 years in prison with a fine of 7.01 million yuan. His long sentence will expire on 24 June 2033. Chen “agreed” with the judgment and did not appeal. His younger brother Chen Weiren was charged with “picking quarrels and provoking trouble and extortion" and was sentenced to four years in prison; Chen Jieren’s ex-wife Liu Min was charged with “picking quarrels and provoking trouble" but was exempted from punishment.

Description:
Li Mengju travelled from Taiwan to Hong Kong on 18 August 2019, to show his support to the Hong Kong protesters in their demonstrations against the extradition bill. On 20 August 2019, he told his friend Chen Yalin (aka Archer Chen) in Taiwan, who is the chief of Fangliao Township, that the Chinese army had assembled at the Hong Kong-Shenzhen border and the situation was tense, he expressed his wish to go to Shenzhen, sent a photo of the Chinese army to Chen and went missing. According to the Chinese media reports much later, Li was detained by the national security officers when he wanted to leave China from Port of Shenzhen. On 25 August 2019, Chen Yalin sought help from Taiwan’s Mainland Affairs Council, as he could not reach Li since 20 August. Chen also contacted Shenzhen Municipal Public Security Bureau, which claimed that it did not have any information regarding Li Mengju’s entry to Shenzhen and asked him to contact the Hong Kong Police. On 28 August 2019, Taiwan’s Mainland Affairs Council confirmed Li’s disappearance.

On 11 September 2019, a spokesperson of the Taiwan Affairs Office, under the State Council of China stated that Li Mengju had been suspected of engaging in criminal activities which endanger national security, and therefore was under investigation in accordance with law. However, he did not disclose which department was in charge of it. On 30 November 2019, Guangzhou Daily reported that on 31 October, the Shenzhen Municipal People’s Procuratorate had approved the Shenzhen National Security Bureau’s application to formally arrest Li Mengju, on suspicion of spying for and illegally providing state secrets to a foreign entity.

On 11 October 2020, Chinese national broadcaster China Central Television (CCTV) revealed the details of Li’s case and the involvement of a so-called “Taiwan Independence" force after a year of Li’s forced disappearance. The show accused Li as “a businessman with certain other intentions", who went first to Hong Kong to support the “black-clad rioters" and then to Shenzhen Bay Sports Center to film the assembly of paramilitary armed police. It is reported that after being told to stop by the police, Li continued to film as he wanted to record the sound of the police assembly. Li was detained on the same day, as he was leaving China via the Port of Shenzhen. On CCTV, Li confessed: “I’m very sorry, and I feel that I have done a lot of wrong things that may have harmed the country.”

Taiwan’s Mainland Affairs Council commented that the accusations are purely “malicious political stunt” from the Chinese side, “falsely accusing our people of espionage” and “harming the relations between the two sides,” in a statement.

Since Li’s detention, China has not followed the international standards regarding criminal procedure, has not respected Li’s rights to a fair trial, to contact or meet his family and lawyer. The so-called television confession was made under the violations of these basic human rights and is entirely incompatible with the judicial procedure.

Date of sentencing: 28 November 2017
Verdict: Convicted of inciting subversion of state power
Sentence: Li was sentenced to 5 years in prison and deprived of political rights for 2 years. He became the first Taiwanese to be sentenced for subverting state power in Mainland China.
Location of detention/imprisonment: Chishan Prison, Hunan Province

Description:
Over the years, Li Ming-che has been interested in the human rights and democratic movements in Mainland China and exchanged with Chinese civil society activists on the Internet. He donated and sent books on literature and social sciences after he had learned that his friends in China wished to read books on human rights and modern history. In August 2016, his parcel to China was confiscated by the Chinese government. Prior to his detention, he served as the programme manager of Wenshan Community College in Taipei City and a volunteer for various human rights groups.

On 19 March 2017, he flew from Taiwan to Macau and entered China through Gongbei Port. He planned to go to Guangzhou to visit friends. However, his friends did not see him at Gongbei Port as appointed and Li did not show up at the place where he originally planned to stay in Guangzhou. On 24 March, Wenshan Community College and Li’s family members held a press conference and demanded China Customs to disclose the video clips to help track Li’s whereabouts. On 29 March, the Taiwan Affairs Office of the State Council of China confirmed that Li Ming-che had been detained and investigated by relevant authorities for allegedly engaging in activities which would endanger state security. The spokesperson refused to disclose specific details because it was a case related to state security under investigation. The subsequent indictment stated that at that time, Lee was under residential surveillance by the Guangzhou State Security Bureau. The formal arrest was approved by the People’s Procuratorate of Changsha City, Hunan Province, enforced by the State Security Bureau of Changsha City, Hunan Province on 12 May, 2017. On 2 July, he was charged with the offense “inciting subversion of state power” along with another defendant, Peng Yuhua.

On 11 September 2017, Li Ming-che was tried with another defendant, Peng Yuhua, at the Intermediate People’s Court of Yueyang City, Hunan Province. The authorities arranged Zhang Guohui and Zhang Zhongwei of Hunan Yuezhou Law Firm to serve as Li’s defenders. It was the first appearance of Li Ming-che since his secret detention in March 2017. He admitted at court that he was “spreading speeches and articles that maliciously attacking the current system of Mainland China and the Mainland Chinese authorities, writing texts that maliciously defaming the system and subverting state power." Li Ming-Che’s mother and wife were allowed to attend the hearing and talked briefly with Li after the hearing. On 28 November, 2017, Li Ming Che was sentenced to five years in prison and two years of deprivation of political rights. He became the first Taiwanese to be sentenced for subverting state power in Mainland China. Li Ming Che did not appeal. The court allowed him to hold a brief conversation with his wife after delivering the sentence.

Li Ming-che’s wife, Li Ching-yu, has researched on Taiwan’s white terror for many years and considers China’s arrest of Li Ming-che as kidnapping and the so-called subversion offense he was accused of as groundless. She rejected China’s offer to remain silence in exchange for private assistance. Furthermore, she does not recognize that China’s current “legal system" as “ruled by law," and therefore refused to hire a Chinese lawyer for Li. Li Ching-yu alleged that Li Ming-che faced an unjust trial and was forced to plead guilty. Her outspokenness and her international appeals made Li Ming-che’s case to be taken seriously in Europe and the United States (e.g. on 6 July 2017, the European Parliament passed a resolution calling on the Chinese authorities to release Li Ming-che; the US Congress added Li to the list of political prisoners in 2017 and the UN Human Rights Council’s Working Group on Enforced or Involuntary Disappearances accepted his case on 23 June 2017 and etc.). As retaliation, the Chinese authorities repeatedly prohibited Mrs Li from visiting her husband and deprived Li Ming-che’s right to get a “family phone card”, which he was entitled to apply in accordance with China’s prison regulations.
